Puppy Guarantee/Agreement Contract
This document is a written guarantee/agreement between Howlin’ Hills Kennels
referred to as "seller" and _______________________________ referred to as "buyer."
Puppy being sold is a (description) _____________________ Male/Female OF__________________________
&_______________________Whelped on the ______ day of _______________, 200(
)
Seller and buyer agree that the above mentioned puppy being sold/purchased
is a purebred Miniature/Toy Australian Shepherd puppy to be sold/purchased as:
______ Pet Quality --_____w/Full registration/breeding rights {however there will not be a breeding quality guarantee}
--______Seller agrees to provide all paper work necessary for the puppy to be registered
with the National Stock Dog Registry or American Stock Dog Registry or MASCA or AKC, which ever registry applies.
Purchase Price Agreement
Buyer agrees to the total payment of $_____________ in purchasing the puppy described
above. Buyer will send Seller a $200 non-refundable** deposit to hold the puppy in buyers name until full payment is received.
Acceptable forms of payment shall be cash, check, money order, or by credit card through "Paypal." The above mentioned
puppy will not be delivered until full payment has been received.
**Deposits
received before a litter is born will be refundable if a specific color, size is unavailable. Buyer will either be given a
full refund or may choose to have seller hold the deposit for the next available litter. Deposits also reserve order of choice,
1st deposit gets first choice, 2nd gets second choice, etc.
Shipping Agreement
– If puppy must be shipped (flown) to buyer, buyer agrees to pay the shipping cost. This will cover the cost of the
crate, health certificate, as well as airfare to most locations. Seller agrees to make all shipping arrangements, having the
puppy flown to a destination airport as close to the buyer’s location as possible.
Health
Guarantee
Seller guarantees/warranties puppy to be in good health, and of
stable temperament having been well socialized. Puppy will have received its first set of vaccinations and been de-wormed
at least once. The general health guarantee is limited to 48 hours after leaving sellers care, worms and parasites excluded.
Seller is not responsible for any vet expenses without prior consent of the seller.
Seller also warranties the puppy purchased to be free of any "genetic"
disorder** such as hip dysphasia, deafness, or serious eye defect until the puppy is 12 months. If a "genetic" disorder
should arise Seller will replace the puppy with another of equal value when available. NO MONEYS WILL BE REFUNDED. Buyer must
have the pup neutered/spayed at buyer’s expense, and send proof before replacement is sent. If Buyer does not comply
with this paper work, Seller is released from replacement.
**A licensed
certified veterinarian must properly diagnose any "genetic" disorder. For example hip dysphasia certification must
be from an OFA board certified vet. Appropriate documentation must be sent to the seller of the disorder and date of diagnoses.
This will be reviewed by Sellers vet.
Puppy Purchase Agreement
Puppy is warranted only for the purpose of
being a companion animal, a part of the family. Although it could be capable of performing other functions, such as show or
breeding quality, no warranty is being given as to the level of those functions. Buyer will also agree to have puppy neutered/spayed
at six months of age if they do not wish to breed the animal. If buyer does decide to breed their puppy, the seller only asks
that they do so responsibly. The seller believes, to the best of their ability, that the puppy is free from genetic defects
covered by the "Health Guarantee," and buyer acknowledges that the seller is not accountable if said puppy will
not breed.
Seller shall have first right of refusal to take pup back ,
if Buyer decides to give up pup. There will be no refund of money.
By
signing this document of "guarantee" and "agreement" both seller and buyer have read the above and understand
all of its contents and agree on the responsibilities of both seller and buyer. Both parties will have a signed copy in their
possession upon delivery of the puppy.
